Raad van State: vreemdelingendetentie was illegaal drukmiddel bij demonstratie Schijnheilig

Volgens de Raad van State was de inzet van vreemdelingendetentie bij de arrestatie van 140 demonstranten bij cultureel centrum Schijnheilig misbruik van bevoegdheden. .

Vreemdelingendetentie mag niet worden gebruikt als drukmiddel om de identiteit van mensen te achterhalen. Volgens Collectief Schijnheilig fungeert de vreemdelingenwetgeving als het afvoerputje van het rechtssysteem, dat ook nog eens misbruikt wordt door mensen actief hun rechten te ontnemen. Schijnheilig hoopt niet alleen dat deze uitspraak impact zal hebben op het beleid ten aanzien van activisten, maar dat er ook een einde komt aan het rücksichtslos laten verdwijnen van mensen in de vreemdelingendetentie

Op 5 juli 2011 werd in groten getale vreedzaam gedemonstreerd tegen de ontruiming van cultureel centrum Schijnheilig. De ME sloeg met veel geweld in op de groep, sloot de straten af en arresteerde alle demonstranten. Een deel van de demonstranten maakte gebruik van hun recht niet mee te werken met hun eigen veroordeling en bleef anoniem. Als 'straf' werden 52 mensen in vreemdelingendetentie geplaatst met goedkeuren van de hulpofficier van justitie. In vreemdelingendetentie gelden niet de basale rechten die je als verdachte binnen het Nederlandse strafrecht hebt en sommige mensen zaten twee maanden vast. Dit gebeurde terwijl er geen enkele verdenking bestond dat er zich 'illegalen' onder de demonstranten bevonden. Bovendien zijn mensen voor slechts een overtreding (het niet verlaten van de demonstratie) overgezet naar de vreemdelingendetentie.

Burgemeester van der Laan liet destijds weten dat het toepassen van vreemdelingendetentie 'standaard beleid' was indien de identiteit van een arrestant onbekend was. De Raad van State maakt echter gehakt van deze praktijk. De Raad van State stelt dat er vele redenen kunnen zijn waarom iemand zijn identiteit niet wenst prijs te geven en wijst de koppeling van de aanhouding voor een overtreding met het vreemdelingentraject af.

Schijnheilig roept iedere demonstrant op contact op te nemen met info@schijnheilig.org om zo samen een massa-politieklacht in te dienen tegen deze massa-arrestatie. Verder wil Schijnheilig dat het 'standaard politieprotocol' dat aanleiding heeft gegeven tot deze zaak per direct door de versnipperaar gaat. Ook doet Schijnheilig een moreel appel aan iedereen om het Nederlandse vreemdelingenbeleid af te wijzen: het is een selectief beleid is dat mensen basale rechten ontzegt.

Op facebook staat een oproep van Wouter Stokhof en Koen van den Berghe voor een demonstratie tegen ACTA, de Anti-Counterfeiting Trade Agreement. Zaterdag 4 februari van 12 tot 21 uur op de Dam in Amsterdam. Sinds SOPA en PIPA is de aandacht voor ACTA explosief toegenomen - en volkomen terecht. What is ACTA?

ACTA is an international trade agreement negotiated by the European Union, the United States, Japan, Canada, South Korea, Australia, Mexico, Morocco, Singapur as well as a few other countries, whose aim is to enforce copyright and tackle counterfeited goods (hence its acronym: Anti-Counterfeiting Trade Agreement).

The main problem with this treaty is that all the negotiations were done secretly, keeping the public and civil organizations out of the table. All the information until 2010 relied on leaks that reveal intentional secrecy to misled the public. ACTA negotiations started on 2007 and finalized in 2010.

Which countries already signed ACTA?

October 2010: Japan and United States, who crafted the treaty, together with Canada, Australia, New Zeland, Singapure and South Korea

January 2011 European Commission, in charge of negotiations, together with non elected representatives from 22 Member States: Austria, Belgium, Bulgaria, Czech republic, Denmark,Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lituania, Luxemburgo, Malta, Poland, Portugal, Rumania, Spain, Sweden and United Kingdom.

The signature of ACTA by European countries does not mean the deal is done, needs to be ratified by the European Parliament. They will vote on june 2012to either ratify or reject ACTA. Please read more how to act and call your MPs, tell them tovote against ratification. This would disarm ACTA in Europe.

Help stop ACTA in Europe

The main two things to do are contacting Members of the European Parliament and helping spread the word about ACTA.

Current main action: call members of the INTA committeeto ask that their report on ACTA recommend the Parliament reject it, and to tell them about the dangers of ACTA.

Which countries have not signed ACTA?

Mexico and Switzerland. In both countries situation is not clear. Mexican Senate voted a non-binding resolution rejecting the ratification of the treaty last year, after celebrating multistakeholder public hearings that prove ACTA was anticonstitutional in Mexico.

Kader Arif, rapporteur for ACTA in the European Parliament quit his role as rapporteur saying:

"I want to denounce in the strongest possible manner the entire process that led to the signature of this agreement: no inclusion of civil society organisations, a lack of transparency from the start of the negotiations, repeated postponing of the signature of the text without an explanation being ever given, exclusion of the EU Parliament's demands that were expressed on several occasions in our assembly."


"This agreement might have major consequences on citizens' lives, and still, everything is being done to prevent the European Parliament from having its say in this matter. That is why today, as I release this report for which I was in charge, I want to send a strong signal and alert the public opinion about this unacceptable situation. I will not take part in this masquerade."

Since no one of them no longer lives in Sweden, they won't go to jail. They are as free today as they were yesterday.

But what enrages us to our inner core is that the system, the empire, the governments, are still allowed to try to boss you and us around with one law crazier than the other. Do you think they will stop with SOPA/ACTA/PIPA? They will not. Because you won't stop sharing those files. Because we will not stay down. Because no one can turn back time. Pijn en schaamte over de koloniale geschiedenis van Nederland in Suriname. Dat overheerst in het leven en werk van schrijver en dichter Edgar Cairo. Het is beklemmend aanwezig in de documentaire 'Edgar Cairo: ik ga dood om jullie hoofd' van Cindy Kerseborn. In de film belichamen het leven en werk van Edgar Cairo het zogeheten 'negerverdriet', dat hem uiteindelijk noodlottig werd.

Edgar Cairo overleed elf jaar geleden. Met tomeloze energie en kracht heeft hij geprobeerd de tegenstellingen te overwinnen, die tussen Surinamers onderling en tussen Surinamers én gevestigde Nederlanders heersen. Terugkerende thema's in het werk van de schrijver, dichter, performer en schilder zijn huidskleur en sekse, maar bovenal de onverwerkte koloniale erfenis.

De zwaar getourmenteerde Cairo werd in Nederland academicus, maar voelde zich tegelijk altijd een Creoolse volksjongen. Hij onderzocht de invloed van het witte denken en de daarmee samenhangende taal in het hoofd van een zwarte Creool. Cairo ontwikkelde zijn eigen taal, een mix van Sranantongo en Nederlands die je nu nog terughoort in de Nederlandse straattaal. Hij legt met zijn werk open wat anderen liever met schaamte bedekken. Zijn uitgebreide oeuvre bestaat niet alleen uit literatuur en poëzie, maar ook uit tweehonderd schilderijen, die met dezelfde passie, ongeduld en avontuurlijkheid zijn gemaakt als zijn geschreven werk.
