Spoed is zelden goed.

English translation:

The police is threatening squatted buildings in Amsterdam and surroundings with speed-evictions, which means eviction without previous notice nor decision by a judge. One of the tools to reverse this trend is to start a court-case against speed eviction.

On October 1st, 2010 , the new law 138A on " Squatting and Vacancy ' was included in the Penal Code. Although this law defines squatting as a crime, squatters still have the right to domestic peace. This means that the police is not allowed to evict squatted buildings without notice and without a court sentence. Thus speed eviction constitute a violation to this right, violation that is allowed only in situations of emergency. This state of ”emergency” could be applied when the property was still in use at the time it was squatted, in case of dangerous situation or when there is disturbance of public order. Only in these cases the police can decide to evict the squat immediately.

The police is now playing with the loopholes of the law, and squatted building are being illegally evicted. Last week this has happened twice in the Amsterdam region: at the Stammerhove 13, Diemen (https://www.indymedia.nl/node/20957) and at the
Ellermanstraat 31, Duivendrecht (https://www.indymedia.nl/node/21054). There are signs that other buildings will be threatened with speed-eviction in the near future.

It is not the first time that the Public Prosecutor and the police use these tactics. In the spring of 2012 the police evicted other squats in the same illegitimate way. In first place the building on the Swammerdamstraat 12, in Amsterdam, was evicted; then the Zeeburgerdijk and the Simon Stevinstraat (see: http://ksuoost.squat.net/2012/05/18/spoedontruimingen-in-amsterdam-oost/). In this last case the squatters offered peaceful resistance, but the officers used violence against the group and many people were arrested (see: https://www.indymedia.nl/node/4699.). As this provoked a large scandal in the public opinion and embaressment for the chief of the police, since then the police had been following prescribed laws and procedures.

Soon a court case to stop speed-evictions will be started. The verdict will have nationwide effect. An email address was opend for questions, critiques or support: denial@puscii.nl . We already have know of other speed-eviction cases from other parts of the country, but we are still looking for more examples, so please share any useful information.

Krakers in Amsterdam en omgeving worden geteisterd door politie die door gebruik te maken van 'spoedontruimingen' onaangekondige razzia's houdt.

Op 1 oktober 2010 is de wet 'kraken en leegstand' in het wetboek van strafrecht opgenomen.
Ondanks dat deze wet het meer dan voorheen strafbaar maakt om te kraken, hebben krakers wel huisvrede. Deze huisvrede zorgt ervoor dat politie niet zonder toetsing door een rechter een gekraakt pandje binnen kan stappen om de krakers te arresteren. Hier is één uitzondering op, de spoedontruiming. In het geval het pand nog in gebruik was, er een gevaarlijke situatie of verstoring van de openbare orde is, kan politie zelf beslissen dat ze wegens urgentie direct gaan ontruimen.

OM en politie spelen art138 (huisvredebreuk) en 138A (leegstandswet) tegen elkaar uit. Via deze loophole kunnen OM en politie nieuw gekraakte panden na een week of wat ontruimen, zonder tussenkomst van een rechter. Afgelopen weken was het alweer twee keer raak in de regio Amsterdam, en ook in de nabije toekomst zijn er aanwijzingen dat er panden met spoedontruiming worden bedreigd. Het kortgeding is een van de middelen die gepland staat om dit tij te keren.

OM en politie proberen dit niet voor het eerst. In het voorjaar van 2012 ontruimde de politie op dezelfde illegitieme manier. Eerst viel in Amsterdam de swammerdamstraat 12 ten prooi, toen het zeeburgerpad en vervolgens werd alles op de Simon Stevinstraat ingezet. Toen krakers vreedzaam verzet boden wisten de agenten ter plekke niet beter dan er met een waas voor hun ogen op los te meppen. Dat bracht zelfs de chef van de Amsterdamse politie en burgermeester van de Laan in verlegenheid. Met gevolg dat de politie zich sindsdien wel aan de gestelde wetten en procedures hield.

Er wordt een kortgeding aangespannen om deze onterechte spoedontruimingen te stoppen. Een uitspraak in dit kortgeding zal landelijk effect hebben. Daarom is er een mailadres (denial@puscii.nl) aangemaakt voor vragen, kritiek of steun. We hebben al een aantal gevallen van spoedontruimingen uit andere delen van het land ontvangen maar zijn nog opzoek naar meer voorbeelden. Dus laat het vooral weten als je er meer weet.

The Sengwer people have lived in the majestic Embobut forest for centuries and their rights to their ancestral lands are protected under the Kenyan constitution and international law. Beleidsmakers zijn voortdurend bezig om Nederlandse bedrijven beter te laten
concurreren met die van andere landen. Daarom moeten we aan de onderkant
steeds weer genoegen nemen met nog lagere lonen, nog verder geflexibiliseerde
banen en nog minder arbeidsrechten. Een extreem voorbeeld daarvan is het
verdere doorvoeren van de voor bedrijven spotgoedkope dwangarbeid. Het kabinet
Rutte II probeert werklozen ook welbewust steeds verder de armoede in te
drukken. Men probeert het overleven met een uitkering bijna onmogelijk te
maken, zodat werklozen zich gedwongen zien om zelfs de meest rotte
onderbetaalde baantjes aan te nemen die de ‘werkgevers’ tegenwoordig voor ons
creëren. Een van de verarmingsmaatregelen die het kabinet nu neemt is de
nieuwe samenwoonboete. De Bijstandsbond en het comité Dwangarbeid Nee, waarin
Doorbraak meedoet, hebben een petitie opgesteld onder het motto
“Armoedebestrijding? Stop de samenwoonboete!”. Onderteken de petitie en doe
ook mee met de verdere strijd van onderop tegen de asociale Rutte, Asscher en

Mobiliteit als organisatievorm: rebellie van vluchtelingen van de
buitengrenzen tot in de binnensteden van de EU

De berichtgeving over protesten van vluchtelingen in Europa en ten zuiden van
de Middellandse Zee houden al meer dan een jaar aan. Nicosia, Tel Aviv en

Rechts dreigt truckersactie van 7 maart te kapen

Een goed woord weet ik er nog niet voor, maar Nederland kent momenteel de
opkomst van een bloedeigen Tea Party: een protestbeweging die authentieke
onvrede over regeringsbeleid doordrenkt met rechtse en uiterst rechtse
thema’s. Een debuut van dit nare verschijnsel dreigt op 7 maart plaats te
vinden, na een voorronde op 21 september op het Malieveld, toen de PVV haar
anti-regeringsprotest hield met openlijke deelname van tientallen neo-nazi’s
en dergelijke. Voor 7 maart roepen diverse initiatieven op om wegen te
blokkeren en het land lam te leggen uit protest tegen het regeringsbeleid. Uit
allerlei toelichtende teksten van sympathisanten blijkt steeds duidelijker dat
het hier om rechts, nationalistisch en xenofoob protest gaat. Radicale,
progressieve, linkse, anti-autoritaire mensen hebben daar niets te zoeken,
tenzij voor een krachtig tegengeluid. Van meelopen achter xenofobe demagogen

Ouders in actie tegen Zwarte Piet-racisme op school

Elk jaar staan anti-racistische ouders voor een dilemma: houden ze hun
kinderen op 5 december thuis of stellen ze hen bloot aan het Zwarte
Piet-racisme op school? Rani Gupta heeft de verantwoordelijkheid bij de school
van haar kinderen gelegd door de medezeggenschapsraad van die school te
verzoeken om Zwarte Piet voortaan te verbannen uit het Sinterklaasfeest. De
halfslachtige en ontwijkende manier waarop de raad haar verzoek behandelt, is
typerend voor de houding van veel scholen. Dat ondervond eerder ook Patricia

Bezwaren goed en wel, maar in die leus zit dynamiet (basisinkomen-discussie
deel 3)

Op de Doorbraak-website komt een buitengewoon interessante gedachtenwisseling
op gang over zin en onzin van het onvoorwaardelijk basisinkomen (van nu af aan
hier als “basisinkomen” aangeduid): een gegarandeerd inkomen voor iedereen,
ongeacht of je betaalde arbeid verricht of niet. Beide geplaatste
discussiebijdragen zien er vooral nadelen in. Ik denk dat er in de leus van
een toereikend en werkelijk onvoorwaardelijk basisinkomen dynamiet zit. Niet
in de formele eis, niet in een beperkte invoering binnen het kapitalisme, maar
wel in het idee en in de leus. De kunst is om het idee en de leus op de juiste
plek en manier tot ontploffing te brengen om een anti-kapitalistische en
anti-autoritaire revolutie en een communistische maatschappij van vrije mensen

11 februari, Den Haag: protest tegen Participatiewet

Binnenkort neemt de Tweede Kamer een besluit over de nieuw in te voeren
Participatiewet. Hoewel PvdA-staatssecretaris Jetta Klijnsma het wetsvoorstel
onder druk van het protest ertegen licht heeft aangepast, maken mensen met een
arbeidsbeperking zich er nog steeds grote zorgen over. Daarom organiseert de
FNV op 11 februari een manifestatie waar WSW-ers en Wajongers actie gaan
